Who inherits first?

First consider lineal descendants; if none, lineal ascendants; then siblings; and finally collateral blood relatives within the fourth degree. Anyone in an earlier priority excludes later priorities. Within the same priority, nearer relatives take precedence. Do not count children and grandchildren, or parents and grandparents, together in one field.

The spouse inherits alongside lineal descendants or ascendants, with a weight 1.5 times that of each co-heir. If neither group exists, the spouse inherits alone and siblings and others are excluded. Without a spouse, heirs in the applicable priority share equally.

An example using fractions

With a spouse and two children of the same degree, the weights are 3:2:2. The spouse therefore receives 3/7 and each child 2/7. Two parents without a spouse each receive 1/2. Results may differ from actual acquisitions under an agreed division or a will.

What this tool does not determine

All entered persons are assumed to be eligible heirs. This tool does not assess unborn children, renunciation, disqualification, loss of inheritance rights, adoption, special benefits, contributions or simultaneous deaths. Counting a deceased child as a living child gives an incorrect result. For a deceased child's branch, use the inheritance by representation calculator.
